Junk Faxes: Prohibits the sending of unsolicited faxes (Business and Professions Code 17538.43) Stayed by a pending lawsuit This law made it illegal for people to send unsolicited advertising faxes to or from a fax machine in California. Violators can be sued for at least $500 per junk fax. The industry sued the state in federal court to prevent the enforcement of this law, and a federal judge stopped the enforcement of the law until the lawsuit gets resolved. Action: DCA’s Consumer Services Unit takes complaints against violators of this law, and will pursue them based on how the pending lawsuit is resolved.
