HOMESTEAD EXEMPTIONS

AB 1046 (Chap. 499); amends CCP sections 753.150 and 703.730

Background: Homestead exemptions protect homeowners who live in their homes from creditors wishing to seize their homes for debts unrelated to loans secured by their homes. Homestead exemptions are also valuable in bankruptcy proceedings.

The new law: Increases the homestead exemption as follows:

  • For a single person from $50,000 to $75,000
  • For a married couple from $75,000 to $100,000
  • From $150,000 to $175,000 if the judgment debtor or spouse is:
    • 65 years of age or older, or
    • Disabled and is unable to engage in substantial gainful employment, or
    • 55 years of age or older with a limited income (annual income of not more than $15,000 or, if married, not more than $20,000 combined income and if the sale is an involuntary sale).
